Man Charged with Pulling a Gun in Trash Dispute

The following information was supplied by the Boston Police Department. Charges listed do not imply convictions.

At 8:29 a.m. on January 7, officers responded to a person with a gun on Marlborough Street.

Officers spoke with the victim in front of 85 Marlborough Street who stated that he and his coworker had been picking up trash in the rear of that residency when a white male came out back and placed trash in the back. When the victim told the suspect to place his trash in the proper place, the suspect went back into his apartment and came back outside holding a black handgun.

The suspect then pointed the handgun at the suspect and said, “Next time you tell me where to put my trash, I’ll kill you.” Then the suspect went back inside.

When officers arrived at the apartment building, the suspect was placed into handcuffs for officer’s safety. When they asked the suspect if there were any weapons in the apartment, the suspect stated, “There’s a shotgun in the closet.” When the officers asked if he had a license to carry, the suspect told officers that he had a license to carry in the state of Florida. 

Officers observed a Glock handgun case in plain view of the doorway. The officers located the shotgun in a case inside the closet.

Officers charged John Durnham of 85 Marlborough Street with assault and battery with a dangerous weapon and unlawful carrying of a firearm.
